A New Security Provisions Order

On 1 November 2009, the Israeli Defense Forces' (IDF) legal adviser for Judea and Samaria issued an order entitled “Security Provisions” [Consolidated Version] (Judea and Samaria) (no. 1651) 5770-2009 [1] (hereinafter: “the Order”). The Order includes more than 300 articles and is intended to consolidate all relevant criminal legislation issued in the West Bank during the years of the IDF's control over the area in order to create a unified criminal code.

This new consolidated order is not intended to change the relevant legislation in the West Bank, but rather to elucidate the applicable military legislation that had previously been issued there in order to allow, inter alia, better legal representation for all the relevant parties. The Order is divided into different chapters by topic, such as detention, criminal procedure, criminal offenses, and administrative orders (which includes the relevant provisions on administrative detention).

The Order will enter into force on 2 May 2010.
